These Terms of Service govern your access to and use of Hapixar’s website, products, and services. By visiting our site, placing an order, creating an account, or using our services, you agree to these Terms and our related policies.
PLEASE READ CAREFULLY. These Terms of Service (“Terms”) govern your access to and use of this website and services provided by HAPIXAR GLOBAL LLC (“Company,” “we,” “us,” or “our”). By visiting our site, placing an order, creating an account, or using any service, you agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, and our Refund & Returns Policy. If you do not agree, please do not use our website or services.
SECTION 1: ELIGIBILITY & ACCOUNT
- You must be the age of majority in your state, province, or country of residence, or have parental or guardian consent, to use our services.
- You agree to provide accurate, current, and complete information when placing an order, creating an account, or contacting us.
- You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
SECTION 2: SHOPIFY PLATFORM & THIRD-PARTY TOOLS
Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell products and services to you. We may also use third-party tools for payments, shipping, analytics, marketing, customer support, reviews, personalization, design preview, fulfillment, and related services. Your use of those tools may be subject to additional terms from those providers.
SECTION 3: PRODUCTS, MADE-TO-ORDER ITEMS & PERSONALIZATION
- Made to order: Many Hapixar products are printed, personalized, engraved, or produced after your order is placed. Production time and shipping time are separate.
- Product images and mockups: We do our best to display products accurately. Minor differences in color, brightness, cropping, size, print placement, and material appearance may occur due to screen settings, lighting, production methods, and manufacturing tolerances. These normal variations are not considered defects.
- Personalization details: You are responsible for reviewing names, spelling, photos, dates, design notes, size, color, and other personalization details before placing your order.
- Artwork proofs: If we provide a proof, production may not begin until approval. Once approved, the proof is considered final, although small production variations may still occur.
- Care and use: Please follow all care and usage instructions provided on the product page or with your product. Our items are lifestyle goods and are not safety equipment, medical devices, or veterinary products.
- Right to refuse: We may decline or cancel orders containing designs, text, photos, or requests that are illegal, infringe third-party rights, hateful, violent, obscene, abusive, misleading, or otherwise violate our policies.
SECTION 4: CUSTOMER CONTENT, PHOTOS & LICENSE
If you upload, submit, email, or provide text, images, pet photos, names, artwork, design notes, reviews, or other content (“User Content”), you confirm that you own or have the necessary rights to use that content and that it does not infringe any third-party rights.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and create derivative works from User Content solely as needed to produce and deliver your order, provide customer support, process replacements or refunds, and operate our services.
If you submit a review, tag us, use our designated hashtags, or otherwise give explicit permission, you grant us permission to display your review, photos, first name, pet name, or related content on our website, social channels, emails, and ads. You may request removal by contacting us.
SECTION 5: ORDERS, PRICING, PROMOTIONS & TAXES
- All orders are offers to purchase and are subject to acceptance by us.
- We may cancel, refuse, or limit orders at our discretion, including for suspected fraud, incorrect pricing, inventory issues, payment problems, or policy violations.
- Prices are shown in the currency indicated and may change without notice.
- We are not responsible for typographical errors, inaccurate product information, incorrect pricing, or technical errors. We may correct errors and cancel orders affected by them.
- Discount codes, coupons, and promotions may have limits, expiration dates, exclusions, or minimum purchase requirements. They cannot be combined unless specifically stated.
- Sales tax may be added at checkout where required. International orders may be subject to customs duties, import taxes, VAT/GST, or local carrier charges, which are the customer’s responsibility unless otherwise stated.
SECTION 6: PAYMENTS
- We accept the payment methods shown at checkout, which may include major cards, PayPal, Shop Pay, Apple Pay, Google Pay, or other available options.
- By submitting a payment method, you confirm that you are authorized to use it and authorize us and our payment processors to charge it for your order.
- Payment processing is handled by third-party providers. We do not store your full payment card details.
- Subscriptions, if offered: If we offer any subscription, auto-renewal, or recurring purchase option in the future, the billing terms, renewal price, and cancellation terms will be disclosed at purchase.
- Chargebacks: If you have an issue with your order, please contact us first so we can help. We may provide proof of production, delivery, communication, and policy terms when responding to chargebacks.
SECTION 7: SHIPPING, DELIVERY & RISK OF LOSS
Production times, shipping methods, tracking updates, delivery estimates, carrier delays, lost packages, and address issues are explained in our Shipping Policy. Delivery dates are estimates and are not guaranteed unless specifically stated.
Title and risk of loss generally pass to you when the order is handed to the carrier. If your order is damaged, lost, incorrect, or not as described, please review our Refund & Returns Policy and 30-Day Quality Guarantee.
SECTION 8: RETURNS, EXCHANGES, CANCELLATIONS & QUALITY GUARANTEE
Our current return, exchange, cancellation, and refund terms are posted in our Refund & Returns Policy and are incorporated into these Terms by reference.
In general, custom and personalized items are final sale once production begins, except when covered by our policies for damaged, defective, incorrect, incomplete, lost-in-transit, or materially not-as-described items. Eligible non-custom items may be returnable within the stated window if unused, unwashed, and in original condition.
Your order may also be protected by our 30-Day Quality Guarantee if it arrives damaged, defective, incorrect, incomplete, or significantly different from the product image, description, or approved proof.
SECTION 9: GIFT CARDS & STORE CREDIT
- Digital gift cards, if offered, are not reloadable, not redeemable for cash except where required by law, and may not be replaceable if lost or stolen.
- Store credit may only be used on our website and may be subject to additional limitations or expiration rules where allowed by law.
SECTION 10: INTELLECTUAL PROPERTY
All website content, including designs, graphics, product images, text, logos, trademarks, page layouts, and other materials, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, modify, sell, or create derivative works from our content without prior written permission.
SECTION 11: ACCEPTABLE USE
You may not misuse our website or services. This includes scraping, interfering with website security, attempting unauthorized access, uploading malware, using the site for unlawful purposes, submitting harmful or infringing content, or engaging in activity that disrupts our operations or other customers’ experience.
SECTION 12: COPYRIGHT OR DMCA NOTICES
If you believe content on our website infringes your copyright, please send a notice including: your signature, identification of the copyrighted work, the URL or description of the material you believe is infringing, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate and that you are authorized to act. SECTION 13: REVIEWS & SOCIAL CONTENT
By submitting a review, photo, testimonial, or social media content to us, or by tagging us in a way that indicates permission to share, you allow us to display that content on our website, social channels, ads, emails, and marketing materials, along with your first name, pet name, or general location if provided. You may request removal by contacting us.
SECTION 14: ELECTRONIC COMMUNICATIONS, EMAIL & SMS
- By placing an order or creating an account, you consent to receive transactional emails such as order confirmations, shipping updates, support messages, and policy-related notices.
- You may opt out of non-transactional marketing emails at any time using the unsubscribe link in our emails.
- If SMS marketing is offered and you opt in, message and data rates may apply, message frequency may vary, and you may opt out by following the instructions in the SMS message.
SECTION 15: DISCLAIMER OF WARRANTIES
Except as expressly stated in our policies, including any applicable 30-Day Quality Guarantee, our website, services, and products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
SECTION 16: LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability for any claim related to the website, services, or products shall not exceed the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business opportunities.
SECTION 17: INDEMNIFICATION
You agree to defend, indemnify, and hold harmless HAPIXAR GLOBAL LLC, its affiliates, officers, employees, contractors, service providers, and partners from any claims, damages, liabilities, losses, and expenses arising from your breach of these Terms, misuse of our services, violation of law, or infringement of third-party rights.
SECTION 18: FORCE MAJEURE
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, labor disputes, carrier disruptions, customs delays, pandemics, supplier issues, power outages, cyber incidents, government actions, or other force majeure events.
SECTION 19: DISPUTE RESOLUTION, ARBITRATION & CLASS-ACTION WAIVER
Informal resolution: Before filing a claim, please contact us at support@hapixar.com so we can try to resolve your concern.
Binding arbitration: Except for small-claims court matters or claims seeking equitable relief for intellectual-property misuse, any dispute between you and us will be resolved by binding, individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, unless prohibited by applicable law.
Arbitration will take place in Denver, Colorado, or by video or telephonic hearing, in English. The arbitrator may award individual relief.
No class actions: You and we waive any right to participate in a class action, class arbitration, private attorney general action, or representative proceeding to the maximum extent allowed by law.
Opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@hapixar.com with the subject “Arbitration Opt-Out” and your full name and order email address.
SECTION 20: GOVERNING LAW
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules, and applicable federal law, except where consumer protection laws in your location require otherwise.
SECTION 21: CHANGES TO THESE TERMS
We may update these Terms at any time. The “Last updated” date will change when revisions are posted. Changes apply to future use of the website and future orders after the effective date. Your continued use of our website or services means you accept the updated Terms.
SECTION 22: MISCELLANEOUS
- Severability: If any part of these Terms is found unenforceable, the remaining terms remain in effect.
- Assignment: You may not assign your rights or obligations without our consent. We may assign our rights or obligations to an affiliate, service provider, or in connection with a merger, sale, acquisition, or restructuring.
- Entire agreement: These Terms, together with our Privacy Policy, Shipping Policy, Refund & Returns Policy, and other posted policies, form the entire agreement between you and us regarding your use of our website and services.
